Options For Students
There are options for college students — especially for first-time offenders. Tennessee offers diversion programs that can keep a student’s record clean. These include:
- Pretrial diversion: This is an agreement reached with the district attorney’s office stipulating that in exchange for serving a period of probation, criminal charges will not be pursued in court. Once the probation period is over, the charges are expunged from the student’s record.
- Judicial diversion: Much like a pretrial diversion, this is a tool by which students charged with a crime can maintain a clean criminal record if they serve a period of probation. Defendants seeking a judicial diversion must first enter a conditional guilty plea with the court, such that any probation violations will result in an automatic guilty verdict. Though the terms are a bit more stringent than those of a pretrial diversion, individuals facing felony charges can seek a judicial diversion.
